STATEMENT BY THE CHAIRMAN
The following application is continued from May 12, 2010:
Stop & Shop Supermarket Company, LLC, 195, 203, 219 and 233 Elm Street 1/19/10
Applicant proposes to demolish the existing buildings on Lot 6 and 7, to expand and improve the existing retail supermarket building, to expand the parking lot area onto lots 6 &7 and to make other site improvements. In anticipation of its development application Stop and Shop requested a determination from the Town Zoning Officer that (1) parking located within the provided street side yard requires only a "c" variance; a monument sign requires only a "c" variance; locating food preparation and other support activities in the supermarket's basement requires only a "c" variance; outdoor display of merchandise, without outdoor sales, does not require a variance; and cart corrals located in the parking lot do not require a variance. By a determination dated December 30, 2009, the Zoning Officer determined that although the cart corrals did not require a variance, the parking in the provided street side yard, a monument sign, locating food preparation in the basement and having outdoor display of seasonal merchandise all would require a "d" variance. By this application, Stop & Shop thus requests that the Board (1) reverse the Zoning Officer's determination with respect to parking in the street side yard, signage, basement activities and outdoor display of seasonal merchandize; (2) issue an interpretation that only "c" variances are required in those four instances; and (3) issue an interpretation confirming that cart corrals do not require variance relief. Appeal taken January 19, 2010. 120 day decision date May 19, 2010.
